NSW Fair Trading Act 1987
Part 3: The Australian Consumer Law as a law of New South Wales – NSW Fair Trading Act 1987

NSW Fair Trading Act 1987 27-32A: Comply with the Australian Consumer Law as the applied law of New South Wales

What does 27-32A require?

The Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 of the Commonwealth), as in force from time to time and modified by the regulations, applies as a law of New South Wales to persons carrying on business in the State and to conduct in the State, and is to be interpreted in accordance with the Acts Interpretation Act of the Commonwealth (sections 27 to 32). Parts 2-3 (unfair contract terms) and 5-2 (remedies) of the ACL also apply to a contract for the supply of goods or services to, or the sale of land to, an owners corporation or community association as if it were a consumer contract (section 32A), so building management, strata management and embedded network contracts with owners corporations are subject to the unfair terms regime. Division 4 applies the ACL to the Crown in right of New South Wales and other jurisdictions.
