NSW Conveyancing (Sale of Land) Regulation 2022
Regulation Part 2 Division 2 and Schedule 3: Implied terms (requisitions, land tax, off the plan, strata and house packages) – NSW Conveyancing (Sale of Land) Regulation 2022

NSW Conveyancing (Sale of Land) Regulation 2022 7: Implied term in every contract: objections, requisitions and the 14-day land tax certificate terms

What does 7 require?

Every contract for the sale of land includes the Schedule 3 section 1 term on objections and requisitions (the purchaser may make requisitions on title within the period and the vendor must answer them, with the rescission and compensation rights the term provides) and, by clause 8, one of the land tax certificate terms: where completion is 14 days or less after the contract, the Schedule 3 section 2 term; where completion is more than 14 days away or no date is agreed, the Schedule 3 section 3 term requiring the vendor to serve a land tax certificate under section 47 of the Land Tax Management Act 1956 before completion so that the purchaser is protected from the land tax charge.
