Every contract for the sale of residential property must include, clearly legible and prominently located, the statement in Schedule 5 Form 1 setting out the purchaser's cooling off rights: rescission before 5 pm on the fifth business day after the contract (the tenth for an off the plan contract), the cases where there is no cooling off period (a section 66W solicitor's or barrister's certificate given at or before contract, sale by public auction, a contract on the auction day after passing in, or exercise of an option), the forfeiture of 0.25 per cent of the price and its recovery from the deposit with refund of the balance. If the statement is missing the purchaser may rescind at any time before completion without forfeiture (section 66X). Clause 17 exempts the Schedule 4 Part 1 and 3 contracts and Part 5 land, other than mortgagee sales and equity of redemption sales of residential property.
