Nigeria Data Protection Act 2023 (NDPA) 38: Data portability

The right of data portability, established by the Commission's regulations, entitles the data subject to receive from a controller without undue delay their personal data in a structured, commonly used and machine-readable format, to transmit it to another controller without hindrance, and where technically possible to have it transmitted directly from one controller to another, on the circumstances, conditions, costs and timing the Commission prescribes (the GAID 2025 Article 37 sets the exercise of the right).
