New Zealand Credit Contracts and Consumer Finance Act 2003
Part 4: Enforcement, remedies, offences, defences and penalties – New Zealand Credit Contracts and Consumer Finance Act 2003

New Zealand Credit Contracts and Consumer Finance Act 2003 92A-92K: Comply with FMA stop orders, interim stop orders and direction orders

What does 92A-92K require?

Where the lender responsibility, record, publication or Part 2, 3 or 3A provisions are, or probably will be, breached in connection with a CCCFA service, or where a restricted communication about such a service is false, misleading or confusing, the FMA can issue a stop order (and an interim one while it decides) banning the supply or advertising it names; where a person breaches or is likely to breach those provisions or an exemption or declaration condition, the FMA can issue a direction order requiring the action or restraint it names. The orders may be made against the persons section 92E names, follow the process in section 92I, and failing to comply has the consequences in section 92J including offences; appeals lie as section 92K provides.
