New Jersey Data Privacy Act 56:8-166.8: Non-discrimination for opting out; disclosed loyalty and incentive programmes

What does 56:8-166.8 require?

A controller must not discriminate against a consumer who opts out of processing for sale, targeted advertising or significant-effect profiling. It may still offer discounts, loyalty programmes or other incentives for the sale of personal data, or different services reasonably related to the value of the data, provided it has clearly and conspicuously disclosed that the offer includes the sale or processing of personal data the consumer could otherwise opt out of.
