Netherlands Works Councils Act (WOR) 27(3): Art. 27(3) Rely on a collective agreement exemption only where it regulates the matter in substance

Consent is not required insofar as the matter is already regulated in substance for the undertaking in a collective labour agreement or public-law employment terms, or, for pension arrangements, insofar as membership of a sector-wide pension fund is compulsory under the Pensions Act. Where the collective agreement leaves room for the entrepreneur's own rules (for example a framework for camera use), the remaining arrangement still needs consent.
