Model Regulation section 9: fire and extended coverage policies with replacement cost or actual cash value – NAIC Unfair Claims Settlement Practices Model Act (MDL-900) and Model Regulation (MDL-902)

NAIC Unfair Claims Settlement Practices Model Act (MDL-900) and Model Regulation (MDL-902) mdl902-s9a-replacement-cost-matching: Under replacement cost coverage include consequential damage from the repair and replace items in the area to a reasonably uniform appearance, at no cost to the insured beyond the deductible

What does mdl902-s9a-replacement-cost-matching require?

When a fire or extended coverage policy settles first party losses on replacement cost, any consequential physical damage caused in making a repair or replacement and not otherwise excluded is part of the loss, and the insured pays nothing beyond the deductible, including no betterment. When replaced items do not match the remaining items in quality, colour or size, the insurer must replace everything in the affected area so that the result looks reasonably uniform, inside and outside, again at no cost beyond the deductible.
