Model Act sections 3 and 4: the general business practice test and the fourteen defined unfair claims practices – NAIC Unfair Claims Settlement Practices Model Act (MDL-900) and Model Regulation (MDL-902)

NAIC Unfair Claims Settlement Practices Model Act (MDL-900) and Model Regulation (MDL-902) mdl900-s3-general-business-practice: An unfair claims practice is actionable when committed flagrantly in conscious disregard of the law, or so often as to show a general business practice

What does mdl900-s3-general-business-practice require?

Section 3 treats it as an improper claims practice when any insurer doing business in the State, whether domestic, foreign or alien, to do any of the things section 4 lists where it does so flagrantly, consciously disregarding the Act or its regulations, or so often that the conduct amounts to a general business practice. Insurers therefore track claim-handling exceptions in aggregate: a single late acknowledgement is a defect, a pattern is a violation, and market conduct examiners test for the pattern.
