NAIC Annual Financial Reporting Model Regulation (Model Audit Rule, MDL-205)
Section 17: management's report of internal control over financial reporting – NAIC Annual Financial Reporting Model Regulation (Model Audit Rule, MDL-205)

NAIC Annual Financial Reporting Model Regulation (Model Audit Rule, MDL-205) mdl205-s17a-c-icfr-report-threshold: Insurers with five hundred million dollars or more of premium file management's report on internal control over financial reporting, or a section 404 report with an addendum

What does mdl205-s17a-c-icfr-report-threshold require?

Every insurer that files an audited financial report and whose yearly direct and assumed premium reaches five hundred million dollars (federal crop and flood reinsurance left out) must prepare a report on the controls over its own, or its group's, financial reporting as at the previous 31 December and file it with the commissioner alongside the section 11 material weakness communication. The commissioner may require the report from a smaller insurer in a risk-based capital level event or in hazardous financial condition. An insurer or group that answers to section 404 of Sarbanes-Oxley directly, or sits in a holding company system whose parent does, or is SOX compliant or within a SOX compliant system, may file the section 404 report with an addendum stating positively that no material processes for preparing the audited statutory financial statements were excluded; where material statutory processes fall outside the 404 scope, it files either a full section 17 report or the 404 report plus a section 17 report for the uncovered controls.
