A controller may not discriminate against a consumer for exercising rights under the Act, including by denying goods or services, charging different prices or rates or providing a different quality; it need not provide a service needing data it does not collect, and may offer different prices or levels in connection with voluntary participation in a bona fide loyalty, rewards, premium features, discounts or club card programme. Contract terms that purport to waive or limit consumers' rights are void (subd. 4).
