A person must not surveil another who is clad only in undergarments, or the unclad genitals, buttocks or breasts of another, or photograph or otherwise capture the visual image of another's undergarments or unclad genitals, buttocks or breasts, in circumstances where the individual would have a reasonable expectation of privacy. Penalties: felony, up to 2 years or 2,000 dollars for surveillance (5 years or 5,000 dollars after a prior conviction), up to 5 years or 5,000 dollars for capture. Peace officers performing their duties and residential security monitoring by the owner or principal occupant (unless lewd) are excepted.
