Part VII: Rights of data subjects – Mauritius DPA

Mauritius DPA 40: Section 40: right to object, including to direct marketing

What does 40 require?

A data subject may object in writing at any time to processing of personal data about the person unless the controller demonstrates compelling legitimate grounds overriding the person's interests, rights and freedoms, or the processing is for legal claims. Objection to processing for direct marketing (communication of advertising or marketing material directed to a particular individual), including related profiling, is absolute: the data must no longer be processed for that purpose. Both rights must be explicitly brought to the data subject's attention.
