For the high-risk AI systems for which the Commissioner is market surveillance authority (biometric identification, categorisation and emotion recognition, emergency call triage, law enforcement, migration and border, justice and elections uses), a provider or authorised representative established in Malta that becomes bankrupt or stops operating before the end of the AI Act Article 18(1) period must still keep the documentation at the Commissioner's disposal for ten years; importers must supply the Commissioner, on reasoned request, all information and documentation including that under Article 23(5) in Maltese or English. Law enforcement deployers need a Magistrate's prior authorisation (or within 24 hours if urgent) for real-time remote biometric identification and must notify each use to the Commissioner; post-remote biometric identification needs authorisation within 48 hours; the Commissioner keeps a national register of the listed high-risk systems and may impose penalties appealable to the Tribunal.
