Anyone who knowingly prevents or impedes, in any way, the performance of the CNPD's tasks commits a criminal offence punishable by eight days to one year of imprisonment and a fine of EUR 251 to 125,000, or either penalty alone. For a controller or processor this turns cooperation with investigations, audits, on-site inspections and information requests into a criminal-law duty, alongside the periodic penalty payments of Article 49 (up to 5 percent of average daily turnover per day) for failing to supply requested information or to comply with a corrective measure.
