A transfer based on standard contractual clauses is valid only if the full text of Annex II is adopted without alteration in a contract signed by exporter and importer, either as a dedicated contract or within a broader contract (including by an addendum), in which case Sections I, II and III of Annex II are attached. No other provision of the contract or related contracts may exclude, modify or contradict the clauses, directly or indirectly. Agents that already used contractual clauses for international transfers had twelve months from publication (23 August 2024) to incorporate the ANPD clauses, a period that ended in August 2025. Clauses of other countries or international bodies recognised by the ANPD as equivalent may be used on the conditions of the recognising resolution.
