Chapter IV and Section 5: Inspections by the Data State Inspectorate – Latvia Personal Data Processing Law (Fizisko personu datu apstrades likums, 2018)

Latvia Personal Data Processing Law (Fizisko personu datu apstrades likums, 2018) S.15-S.5: Section 15 with Section 5(1) Cooperation with Inspectorate inspections and marking of restricted information

What does S.15-S.5 require?

The Inspectorate may inspect any processing, visit the place of processing (announcing purpose, time and place and asking the controller to ensure an authorised representative is present, whose absence does not stop the inspection), enter State institutions and the production, storage, commercial and other non-residential premises that legal and natural persons use in Latvia, access registers, information systems and databases, and require information, documents and copies free of charge, including information of limited accessibility. A controller or processor supplying information it wants treated as information of limited accessibility must identify the specific documents and give the grounds; if the request is missing or unfounded and not corrected within seven days of the Inspectorate's notice, the information is protected only as internal-use information under the Freedom of Information Law, and the Inspectorate may ask for a copy without the restricted content.
