Part 128: Administrative procedures – ITAR - International Traffic in Arms Regulations

ITAR - International Traffic in Arms Regulations 128.5 and 128.13: Respond to charging letters and appeal within the deadlines

A respondent must answer a charging letter within 30 days of service, admitting or denying each allegation (a failure to deny is an admission), setting out its defences and any demand for an oral hearing, filed in duplicate with the Administrative Law Judge and copied to the Deputy Assistant Secretary; failure to answer can lead to default (128.4, 128.5). An appeal from a final order denying export privileges or imposing civil penalties must be filed in writing with the Under Secretary for Arms Control and International Security within 30 days of receiving the order, stating the grounds (no substantial evidence, prejudicial legal error, or an arbitrary order); consent orders cannot be appealed and an appeal does not stay the order (128.13).
