ICC Incoterms 2020 - International Commercial Terms INC: orporate the chosen rule with the year and a precisely named place, and use the right rule for the mode

What does INC require?

To make the Incoterms 2020 rules apply, the contract should say so explicitly, by stating the chosen rule, then the named port, place or point, then 'Incoterms 2020' (for instance FOB followed by a named port of shipment, or DAP followed by a full street address, each ending in Incoterms 2020); if the year is omitted, a judge or arbitrator cannot tell which edition was intended. The named place matters even more. In all rules other than the C rules it is where the goods are delivered and where risk passes; in the D rules it is both where delivery happens and how far the seller must carry; in the C rules it marks how far the seller must book and pay carriage, which is not where delivery happens. Name the port, place or point as exactly as geography permits, since an FOB term with an uncertain port of shipment, or a CPT term with a vague destination, leaves both sides unsure where their duties lie. Pick the rule to match the transport mode: the four maritime rules (FAS, FOB, CFR, CIF) only where the seller loads the goods aboard, or places them beside, a ship in a port, and the seven any-mode rules where goods pass to or from a carrier anywhere else; using FOB at an inland point, or CIF to a seaport when the goods are headed inland, creates gaps, overlaps and cost. The rules are binding obligations, not just price markers, and the contract need not carry the trademark symbol.
