FSC Mauritius Guidelines on Cloud Computing Services (2023) 5.1: Use a written contract with the required cloud clauses

What does 5.1 require?

A licensee enters a written contract with each selected provider for the cloud services acquired. The contract contains clauses that define clearly the roles and responsibilities of licensee and provider, including the incident management and dispute resolution processes; oblige the provider to keep the licensee adequately informed and able to reach its stored data, including when the storage or processing location or the contractual arrangements change; oblige the provider to give reasonable notice of any such change; give the licensee the right to terminate where, among other things, it has concerns about the provider, with the post-exit strategy agreed and a duty to secure a smooth exit and transition to another provider or to the licensee itself; and set the arrangements that keep the services compliant at all times with the laws and regulations of Mauritius.
