French Sapin II Law (Law No. 2016-1691) 17.I: Article 17 I: managers take measures to prevent and detect corruption and influence peddling in France and abroad

What does 17.I require?

The persons named in Article 17 I must take the measures needed to prevent and detect corruption and influence peddling committed in France or abroad, through the eight measures in II. The AFA reads the duty as personal to the governing body (instance dirigeante): it initiates the programme, approves its design and its risk map, sets a zero-tolerance policy, provides the means, oversees deployment and checks through indicators and control and audit reports that the programme is organised, effective and current; boards and supervisory bodies should have the programme and its updates presented to them periodically (recommendations paragraphs 92 to 100). The AFA also recommends covering related offences such as forgery, misuse of company assets, handling and laundering (paragraph 88).
