Internal review and review by the Information Commissioner (Parts VI-VII) – Freedom of Information Act 1982 (Australia)

Freedom of Information Act 1982 (Australia) part6-internal-review: Internal review: application, fresh decision within 30 days, and deemed affirmation

A person affected by an access refusal or access grant decision may apply in writing for internal review, generally within 30 days of the decision being notified (s54B); the agency must arrange for a person other than the original decision-maker to make a fresh decision within 30 days of receiving the application, with the same reasons-for-decision requirement applying (s54C). If no decision issues within that 30-day period, the original decision is deemed affirmed on the last day of the period, subject to the agency's ability to apply to the Information Commissioner for more time (s54D).
