A controller wilfully disregards a consumer's age if facts readily available should reasonably have led it to question whether the consumer was a child and it then failed to perform reasonable age verification; using a reasonable age verification method for all consumers protects it unless it later gains actual knowledge and fails to act. Before letting anyone exercise rights as a parent of a known child, the controller must conduct reasonable parental verification (for example obtaining the parent's details from the child, confirming the relationship with documents or information, and verifying the parent's identity and age by commercially reasonable means).
