Fiji Data Protection Bill (2020) FjDPB-Scope-Defs: Scope, Application and Definitions

Fiji Data Protection Bill 2020 Part I - Preliminary. SCOPE: applies to organisations + persons processing personal data in Fiji + processing of personal data of individuals in Fiji by an organisation outside Fiji where the processing is in connection with the offering of goods or services to individuals in Fiji or the monitoring of behaviour of individuals in Fiji (extraterritorial - mirrors GDPR Art.3(2)). DEFINITIONS: PERSONAL DATA = data, whether true or not, about an individual who can be identified from that data or from that data + other information accessible to the organisation; ORGANISATION = any individual + body + association + corporation processing personal data (similar to Singapore PDPA s.2); CONTROLLER + PROCESSOR roles per GDPR-like distinction. CONSTITUTIONAL PRIVACY: Section 24 of the 2013 Constitution of Fiji provides a fundamental right to personal privacy + the Bill implements this constitutional right at the sectoral data-protection level. EXEMPTIONS: household + personal purposes; journalistic + literary + artistic expression; national security; law enforcement (limited).
