Screen individuals before authorising access to the system through state-of-residency and national fingerprint-based record checks under an FBI-approved authority (a federal statute or a state statute approved under Public Law 92-544), with the agency's own state check where the person resides elsewhere and consistency with 5 CFR 731.106, OPM guidance or agency policy where appropriate; route access requests through the CSO, Authorized Recipient Official or IA Official, who approve access; withhold access while any criminal record is reviewed, deny it on a felony conviction unless a variance is granted in extenuating circumstances, allow it on misdemeanours the official finds not disqualifying, notify the contracting agency and delay access for contractors with a record, review fugitives and unconvicted arrests, decide continued access after a later arrest or conviction, deny access that would not be in the public interest with written notice to the appointing authority, and keep a list of personnel authorised for unescorted access to unencrypted CJI available to the official on request; and recommend rescreening under the same authority.
