Title VI: Evaluation – EU REACH Regulation (Regulation (EC) No 1907/2006)

EU REACH Regulation (Regulation (EC) No 1907/2006) 40-46: Respond to dossier and substance evaluation decisions by the deadlines set

What does 40-46 require?

The Agency examines testing proposals in dossiers (Article 40) and checks registrations for compliance with the information requirements, adaptations, chemical safety reports and opt-out explanations (Article 41); competent authorities of Member States evaluate substances in the Community rolling action plan and may request further information beyond Annexes VII to X (Article 46). Each process ends in decisions that require registrants to submit specified information, carry out tests or update dossiers by a deadline, which the registrant must meet; registrants may comment on draft decisions within 30 days and, where several registrants are concerned, should agree who performs a required test. Agency decisions can be appealed.
