EU Capital Requirements Regulation (Regulation (EU) No 575/2013) 192-241: Credit risk mitigation: recognise only legally effective, enforceable protection supported by written legal opinions

What does 192-241 require?

Credit protection may reduce capital only where the technique and the procedures around it make it legally effective and enforceable in all relevant jurisdictions; on request the institution must provide its most recent independent, written and reasoned legal opinion supporting that conclusion. The institution must take all appropriate steps to ensure the effectiveness of the protection and manage its residual risks; funded protection must use eligible, sufficiently liquid and value-stable assets; unfunded protection must come from eligible providers under qualifying guarantees or credit derivatives; and netting, collateral haircuts, maturity mismatches and the comprehensive or simple methods are applied as Articles 195 to 241 set out.
