For currency exchange and cheque cashing offices, trust or company service providers, gambling service providers and financial mixed activity holding companies, supervisors verify that senior managers and beneficial owners are of good repute and act with honesty and integrity, and that senior managers have the knowledge and expertise their functions need. For the other non-financial obliged entities listed in the Directive, persons convicted of money laundering, its predicate offences or terrorist financing, or their associates, must be kept from professional accreditation, senior management functions and beneficial ownership. Supervisors re-check this on a risk-sensitive basis, in particular when there are reasonable grounds to suspect money laundering or an increased risk, check the AMLA central database and criminal records, and may require the removal or temporary ban of unfit managers and the divestment of holdings by convicted beneficial owners. For the obliged entities in Article 3, points (3)(n) and (o), of the AML Regulation the Article applies from 10 July 2029.
