The RMP is available to the public under CAA section 114(c) and 40 CFR part 1400. The owner or operator must hold a public meeting to present the 68.42(b) accident information within 90 days of any RMP-reportable accident with known offsite impacts; disclosure of classified or restricted information follows the applicable laws. On request from anyone residing, working or spending significant time within 6 miles of the fenceline, it must provide, within 45 days, for all regulated processes: the names of regulated substances; SDSs; the five-year accident history; emergency response summary information (responding or non-responding status, the local organisations last coordinated with, and, for 68.95 sources, public notification procedures); a list of scheduled exercises within a year (without dates); LEPC contact information; and declined recommendations and justifications from natural hazard, power loss, siting and code gap evaluations; in English or at least two other commonly spoken languages as requested. It must give ongoing notice on a website, social media or other public means that this information is available on request, what can be requested and how (including verifying presence within 6 miles), and where community preparedness information such as shelter-in-place and evacuation procedures can be found, and keep records of requesters for five years.
