EPA Risk Management Program (40 CFR Part 68) 68.115: § 68.115 Threshold determination

A threshold quantity is present if the total quantity of a listed regulated substance in a process exceeds the 68.130 threshold. In determining this: a toxic substance below 1 percent by weight of a mixture need not be counted, nor (except for oleum and toluene diisocyanates) a mixture portion where the owner documents a partial pressure below 10 mm Hg under handling or storage conditions; a flammable substance below 1 percent need not be counted, but at 1 percent or more the entire mixture weight counts unless the mixture is shown not to have an NFPA 704 flammability rating of 4; regulated substances in gasoline in distribution or related storage as engine fuel, and in naturally occurring hydrocarbon mixtures (condensate, crude oil, field gas, produced water) before entering a natural gas processing plant or refinery process unit, are not counted; nor are substances in articles, in structural components, in routine janitorial products, in employees' personal items, in process or non-contact cooling water drawn from the environment or municipal sources, or in compressed or combustion air; nor quantities used in laboratories under a technically qualified individual, except specialty chemical production, pilot plant operations and activities outside the laboratory.
