Ecuador Ley Orgánica de Protección de Datos Personales (LOPDP) 45: Art. 45 and the amended Arts. 78, 81, 82 and 83 of the Ley Organica de Telecomunicaciones: secrecy of communications and telecommunications providers' duties

Telecommunications providers must guarantee the secrecy of communications and the security of personal data, and may use equipment that records the content of specific communications only by court order; unauthorised recording or interception is subject to the Act. Through its amending provisions the Act also requires providers to secure their networks to protect personal data; to inform subscribers of their rights regarding directories and let them opt out of directories free of charge; not to use personal data, service-use, traffic or consumption-pattern information for commercial promotion, nor sell, cede or transfer it, without consent specifying the data, duration and purpose and easily withdrawable; and, when technical control reveals communication contents, to coordinate with the Authority so the media are neither stored nor disclosed and are destroyed at once.
