Data (Use and Access) Act 2025
Part 1: Access to customer data and business data (smart data schemes) – Data (Use and Access) Act 2025

Data (Use and Access) Act 2025 s.8-12: Sections 8 to 12: Enforcement, penalties, fees and levies under data regulations

Regulations can appoint a public authority as enforcer with powers to require documents or information, require an individual to attend and answer questions, and enter, inspect, search and seize (a private dwelling only under a justice's warrant), subject to parliamentary privilege, legal professional privilege and self-incrimination protections; to issue compliance notices enforceable like court orders; and to publish statements that a person is not complying. Offences with an unlimited or specified fine can be created for false or misleading information and for obstructing access to information, documents or equipment. Financial penalties must follow published guidance, a notice of intent, an opportunity to make representations and a final notice, with a right of appeal. Fees can be charged by data holders, decision-makers, interface bodies and enforcers for their duties (possibly above cost), and a levy can be imposed on data holders or third party recipients to meet the costs of decision-makers, interface bodies and enforcers.
