Part 5 Chapter 1: Data protection amendments (pointers to the amended UK GDPR and Data Protection Act 2018) – Data (Use and Access) Act 2025

Data (Use and Access) Act 2025 s.77: Section 77: Transparency exemption for research further processing and disproportionate effort (UK GDPR Articles 13 and 14)

Relieves a controller of giving further-processing information under Article 13(3) where the new purpose is only research, archiving or statistics under Article 84B and giving it is impossible or disproportionate, and restates the Article 14(5) exemptions (impossible or disproportionate effort, or seriously impairing the objectives); disproportionate effort depends on the number of data subjects, the age of the data and the safeguards, and a controller relying on it must protect the data subjects' interests, including by publishing the information.
