Cyber Security Act 2024 (Australia) 22: s 22 Right to internal review of a compliance, stop, recall or variation notice within 30 days

What does 22 require?

An entity may apply in writing to the Secretary within 30 days of a compliance, stop or recall notice, or a variation of one, for internal review by the Secretary or, where the Secretary made the decision personally, by a delegate not involved in it; within 30 days of the application the decision-maker must review and affirm, vary or revoke the decision, substitute another decision where revoked, and give written reasons as soon as practicable. A notice may be varied to correct an error or to rectify the non-compliance adequately, after notice and 10 days for representations, and revoked when its grounds no longer hold, after which no further notice may issue for that non-compliance (s 21).
