The legal basis gives a high degree of certainty; the rules, procedures and contracts are clear and consistent with law; the FMI can explain the legal basis to authorities, participants and where relevant their customers; its rules are enforceable, with a high degree of certainty that its actions will not be voided, reversed or stayed; and an FMI operating in several jurisdictions identifies and mitigates conflict-of-laws risk.
