Verifiable parental consent (312.5) – COPPA

COPPA 312.5(b): § 312.5(b) Methods for verifiable parental consent

What does 312.5(b) require?

The operator must make reasonable efforts, considering available technology, to obtain consent by a method reasonably calculated to ensure the person consenting is the parent. Recognised methods: a signed consent form returned by post, fax or scan; a credit card, debit card or online payment system that notifies the account holder of each discrete transaction; a toll-free call or video conference with trained personnel; checking government-issued identification against databases with prompt deletion afterwards; knowledge-based authentication with dynamic multiple-choice questions a child of 12 or under could not reasonably answer; a verified government photo ID compared with a live facial image by facial recognition confirmed by trained personnel, with prompt deletion; and, only for operators that do not disclose children's information, email plus or text plus (with a confirmatory message or confirmation by letter or call, and notice that consent can be revoked). An approved safe harbor may approve other methods meeting 312.5(b)(1) for its members (312.5(b)(3)).
