A payment service provider is liable for transactions executed without the customer's authorisation, transfers after a report of forgery, loss or theft, transactions despite the customer's Article 48 notice, failure to follow the customer's instructions, and technical malfunction, operating error or a flawed instrument, except for force majeure or customer default. Where liable it must reimburse the customer within 30 days of the customer's notice, including the transaction fee, charges and any late-payment fine resulting from the transaction; the translation says this sum does not account for damages the customer may suffer. Customers must report unauthorised or mistaken transactions and report loss or theft within two days of discovery; without evidence of customer default the provider bears the loss in full.
