For a video or audio recording of a critical incident (an officer- or custodial-officer-involved firearm discharge at a person, or a use of force causing death or great bodily injury), disclosure may be delayed during an active investigation for up to 45 calendar days from when the agency knew or should have known of the incident if disclosure would substantially interfere with the investigation, with a written, specific basis and an estimated disclosure date given to the requester; delay may continue past 45 days on the same substantial-interference test, and past one year only on a clear-and-convincing-evidence standard, with the withholding reassessed and the requester notified every 30 days. Where release would violate a depicted subject's reasonable expectation of privacy, the agency may redact the recording (without impairing the viewer's ability to understand the events) or, if redaction cannot adequately protect that privacy interest, may withhold it from the public while still disclosing it, redacted or not, promptly to the depicted subject, their representative, or (if a minor or deceased) their parent, guardian or authorized family member or representative (s7923.625).
