Australian Education Services for Overseas Students Act 2000 and National Code 2018 (Australia) NC-9.3-9.6: Standard 9.3 to 9.6 Suspension or cancellation by the provider

A provider may suspend or cancel an enrolment on grounds including misbehaviour, failure to pay fees as set out in the written agreement, or breach of progress or attendance requirements handled under Standard 8. Before it does so it must tell the student in writing of its intention, the reasons and the right to appeal under its internal complaints process within 20 working days. For any deferral, suspension or cancellation it must tell the student to seek advice from Immigration and report the change under section 19 of the Act. A suspension or cancellation under 9.3 cannot take effect until the internal appeal is complete, unless the student's health or wellbeing or the wellbeing of others is likely at risk.
