Australia Therapeutic Goods (Medical Devices) Regulations 2002
Part 6A, Part 7, Schedule 3A and Schedule 4: exemptions, clinical trials, authorised supply and emergency devices – Australia Therapeutic Goods (Medical Devices) Regulations 2002

Australia Therapeutic Goods (Medical Devices) Regulations 2002 sch3A: Unused emergency medical devices: when an emergency exemption ends, notify the devices on hand, store and dispose of them as the Secretary directs (destruction, export, supply or relocation) and keep disposal records

What does sch3A require?

Where devices were imported or supplied under an emergency exemption (section 41GY of the Act) and remain unused when the exemption ends early or expires, Schedule 3A requires the person holding them to notify the Secretary of the devices on hand, store them as required, and dispose of them only as the Secretary directs, by destruction, export, supply or relocation, with the owner paid where they are supplied on. Records of the devices and their disposal must be kept, and failure to comply with the Schedule is an offence. Devices that have since been included in the Register, exempted, approved or authorised can be dealt with under those rules instead.
