Australia Therapeutic Goods Act 1989
Chapter 4 Parts 4-5 and 4-6: including medical devices in the Register, conditions, suspension and cancellation – Australia Therapeutic Goods Act 1989

Australia Therapeutic Goods Act 1989 s41FN-5: Automatic ARTG condition: keep all advertising material for the device consistent with the intended purpose certified in the ARTG application

What does s41FN-5 require?

It is a condition of every inclusion that advertising material for devices of that kind is consistent with the intended purpose certified under section 41FD. Claims extending beyond the certified intended purpose breach the condition (an offence and civil penalty under sections 41MN and 41MNA) and may also be false advertising under sections 41ML and 41MLB and a breach of the Therapeutic Goods Advertising Code.
