An electronic address given as the unsubscribe address in a commercial electronic message must meet these conditions (made for s 18(1)(g) of the Act): using it must not require the recipient to use a premium service; using it may cost no more than it normally costs to use that type of address with the same technology the message arrived on; it must not require the recipient to pay a fee or charge to the sender or a related person (someone paid under an arrangement with the sender for use of the address), except a carrier or carriage service provider's ordinary periodic charges; and it must not require the recipient to give personal information (as the Privacy Act 1988 defines it) beyond the address that received the message, and must not make the recipient sign in to, or open, an account with the sender or the authoriser. Applies to messages sent on or after 1 April 2021.
