Australia Social Security Act 1991 (Age Pension: qualification, income test and assets test)
Part 3.12 Divisions 3 and 4: Home equity access scheme and retirement village residents – Australia Social Security Act 1991 (Age Pension: qualification, income test and assets test)

Australia Social Security Act 1991 (Age Pension: qualification, income test and assets test) 1133-1144: Home equity access scheme: qualification, request, rate effect, charge over real assets and recovery after death

What does 1133-1144 require?

A person qualified for or receiving age pension (or the other listed pensions) who, or whose partner, has real assets in Australia and is not bankrupt or subject to a personal insolvency agreement, may request to participate in the home equity access scheme to receive a loan topping the pension up to the maximum rate (or a fortnightly amount and advance lump sums within the limits), repayable with compound interest at the rate determined; the request must specify the real property to secure the loan and, if chosen, a nominated amount or maximum loan amount (sections 1133 to 1137). The debt is secured by a statutory charge over the real assets in favour of the Commonwealth, which must be registered (sections 1138, 1143), is not recoverable until after the person's death (or the partner's death where the partner was participating, with the deferrals section 1139 provides), and participation ends on the events in sections 1141 and 1142. The no-negative-equity guarantee limits the debt to the value of the secured property.
