Australia R&D Tax Incentive (Income Tax Assessment Act 1997 Division 355) 355-35: s 355-35 Confirm the claimant is an R&D entity

Only an R&D entity can claim: a body corporate incorporated under an Australian law, a body corporate incorporated under a foreign law that is an Australian resident, or a foreign-incorporated body resident in a country with a double tax agreement defining permanent establishment that carries on business in Australia through a permanent establishment (to the extent of that business). Each includes a corporate trustee of a public trading trust. An exempt entity cannot be an R&D entity; individuals, partnerships, ordinary trusts and exempt entities are outside the incentive (R&D partnerships of R&D entities are covered through Subdivision 355-J).
