Where legal assistance to an eligible person under Part 9 of the Legal Services Directions 2025 (previously Appendix E of the 2017 Directions, replaced by the 2026 (No. 1) amendments to both delegations) needs an indemnity, the delegate may grant it once satisfied that the criteria for the assistance and any conditions involving the indemnity are met. For this purpose the penalty-indemnity bar, the two policy principles and the remote-event thresholds do not apply, so such an indemnity may cover fines, penalties, damages or legal costs awarded against the assisted person.
