Australia Online Safety Act 2021
Part 4: Basic online safety expectations and reporting – Australia Online Safety Act 2021

Australia Online Safety Act 2021 s46(1)(a)-(b): Basic online safety expectation: reasonable steps for safe use, in consultation with the Commissioner

What does s46(1)(a)-(b) require?

Where the Minister has determined basic online safety expectations for the service (s 45: social media services, and classes of relevant electronic services and designated internet services), the determination must include the expectation that the provider takes reasonable steps to ensure end-users can use the service in a safe manner, and that the provider consults the Commissioner in working out what those reasonable steps are. The expectations are not enforceable by court proceedings (s 45(4)); the Commissioner may prepare, give to the provider and publish a statement that the provider has contravened, or has complied at all times during a period with, the applicable expectations (s 48).
