Australia National Vocational Education and Training Regulator Act 2011 s62-64: ss 62 to 65 and 140 Answer ASQA's written requests for information, documents and things

A person who is or was connected with an NVR registered training organisation, a former RTO, or an organisation holding itself out as one, gives the information and produces the documents or things ASQA requests by served, signed written notice, within the period stated (at least 14 days, or not less than 24 hours if ASQA considers it reasonably necessary) or any extension; failure is an offence of 150 penalty units (s 64). Self-incrimination is no excuse, though what an individual gives is not admissible against them except for listed offences (s 65). A person ASQA requires to assist with civil penalty proceedings gives that assistance (s 140(5), offence of 150 penalty units).
