Australia Model Code of Practice: Managing Risks of Hazardous Chemicals in the Workplace 5.1: 5.1 Provide health monitoring where the Regulations require it (r 368)

A PCBU must ensure health monitoring is provided to a worker doing ongoing work using, handling, generating or storing hazardous chemicals if there is a significant risk to health from a chemical in Schedule 14 table 14.1, or if the PCBU identifies a significant risk of exposure to another chemical and valid techniques exist to detect the health effect, or a valid way to determine biological exposure exists and it is uncertain whether the biological exposure standard was exceeded. Health monitoring identifies changes in health from exposure and is not a substitute for controls but a check on them: if results show adverse effects the controls must be reviewed. The PCBU must inform workers and prospective workers of the requirements; ensure monitoring is by or under a registered medical practitioner with relevant experience, consulting workers on the choice; pay the costs; give the practitioner the required information about the worker; take reasonable steps to obtain the report promptly and give it to the worker; give the regulator a copy where results suggest disease, injury or illness or remedial measures are recommended; pass the report to other PCBUs with a duty; keep reports confidential for at least 30 years (40 for asbestos); and not disclose them without the worker's written consent unless the Regulations require. There are specific rules for lead and asbestos.
