Australia Insurance Contracts Act 1984 (Cth) s14: s 14 Do not rely on a policy provision where doing so would fail the utmost good faith

A party may not rely on a provision of the insurance contract where reliance would amount to failing to act with the utmost good faith. In deciding whether an insurer's reliance is in good faith, the court considers any notice of the provision given to the insured, including a s 37 unusual terms notice.
