Australia Insurance Act 1973 (Cth) s24: s 24 A disqualified person must not act, and the entity must not allow one to act, as director, senior manager or agent

It is an offence for someone disqualified to hold, or perform the role of, director or senior manager role at a general insurer, at an authorised NOHC, or for a corporate agent, or as senior manager or Australian agent of a foreign general insurer (s 24(1)-(2); up to 2 years' imprisonment, or 60 penalty units for the strict-liability form). A body corporate separately commits an offence (250 or 60 penalty units depending on fault) if it lets that disqualified individual hold or perform the role (s 24(4)-(5)). The entity screens every director, senior manager, auditor and actuary appointment against disqualification before it takes effect and keeps monitoring for a disqualification arising during the appointment.
